Frequently asked questions
How is the hourly wage of a monthly-paid employee calculated?
Under Section 68 of the Labour Protection Act, divide the monthly salary by 30, then by the normal working hours per day. For example, a salary of 15,000 baht with 8 hours a day = 15,000 ÷ 30 ÷ 8 = 62.50 baht per hour. For daily-paid employees, divide the daily wage by the normal working hours per day.
What multiplier applies to each type of OT?
Overtime on a working day is paid at no less than 1.5x the hourly wage (Section 61). Work on a holiday during normal hours earns monthly-paid employees an additional 1x at least, and daily-paid employees at least 2x (Section 62). Overtime on a holiday is paid at no less than 3x (Section 63).
Why does holiday work pay 1x for monthly employees but 2x for daily employees?
Monthly-paid employees already have holiday pay included in their salary, so when they work they receive an additional 1x. Daily-paid employees are not paid for holidays, so they receive 2x the hourly wage. The actual totals received are therefore similar.
What is the maximum number of OT hours?
A ministerial regulation limits overtime and holiday work combined to 36 hours per week, and the employer must obtain the employee's consent each time. This tool does not check that limit.
Can I pay based on this result directly?
These figures are the legal minimum rates. Organizations may pay more, and some positions, such as those authorized to act on behalf of the employer, or certain types of work under Section 65, may not be entitled to overtime pay under this formula. Check the employment contract and your organization's work rules.
